HB 32: WORKERS’ COMPENSATION: CONTROLLED SUBSTANCES TESTING

A bill pertaining to an employer establishing a policy requiring drug testing for certain controlled substances prescribed in a workers’ compensation context. If the employee tests negative for the prescribed substances, then the employer is not liable for future payments for controlled substances.

The Committee supports this bill. The proposed legislation addresses the problems surrounding diversion of powerful and addictive narcotic medications and provides substantive relief for employers when there is an instance of non-compliance.
